  1. Virtual CD trial version License Agreement

  3. PLEASE READ THIS SOFTWARE LICENSE AGREEMENT ("LICENSE") CAREFULLY BEFORE 
  4. PRESSING THE "YES" BUTTON BELOW.
  5.  
  6. The computer software programs supplied with Virtual CD are
  7. proprietary materials belonging to Microtest GmbH
  8.  
  9. Do not use the Virtual CD trial version unless you have read and agreed 
  10. to the terms and conditions of this License Agreement. In using Virtual CD
  11. you are entering into a binding contract with Microtest. If you do
  12. not agree with these terms and conditions, you must not install the software.
  13. In the case of electronic distribution, you must delete all software programs 
  14. and documentation relating to this product.

  16. Definitions
  17.  
  18. The following definitions apply to the terms as they appear in this agreement.
  19. * Microtest means Microtest GmbH
  20. * Product means the Software and related Documentation.
  21. * Software means all of the Virtual CD computer programs in machine
  22.   readable form contained in the Virtual CD package and any updates 
  23.   to the computer programs.
  24. * Documentation means the online help and other printed materials
  25.   accompanying the Software.

  27. License Grant
  28.  
  29. This License Agreement determines your rights with respect to the Product.
  30. Microtest retains the ownership of the Software. By using this Software or
  31. permitting its use, you indicate your consent to the terms and conditions
  32. of this License Agreement.
  33.  
  34. Microtest grants you a nonexclusive license to:
  35. * Use the Client Software on any one compatible computer for a evaluation
  36.   period of 30 days after first installation. If after your 30 day 
  37.   evaluation period you would like to continue to use Virtual CD you must
  38.   purchase the licensed version at www.microtesteurope.com
  39.  
  40.  
  41. You shall not:
  42. * Alter, merge, modify, reverse engineer, or adapt the Product in any
  43.   way, including by disassembling or decompiling.
  44. * Loan, rent, lease, sell or sublicense the Software.
  45. * USE THE PRODUCT IN THE OPERATION OF NUCLEAR FACILITIES, AIRCRAFT NAVIGATION 
  46.   OR COMMUNICATION SYSTEMS, OR AIR TRAFFIC CONTROL MACHINES IN WHICH CASE THE 
  47.   FAILURE OF THE PRODUCT COULD LEAD TO DEATH, PERSONAL INJURY, OR SEVERE
  48.   PHYSICAL OR ENVIRONMENTAL DAMAGE.

  51. This license will terminate automatically if you fail to comply with any of
  52. the terms of this License Agreement, and on any such termination you will
  53. destroy the CD-ROM disc and any back-up copies and delete all installations
  54. of the Software.

  56. Microtest retains all rights not expressly granted. The Software is
  57. protected by United States copyright and other federal and state laws.
  58.  
  59. Limited Warranty
  60.  
  61. Microtest makes no warranty or representation, either express or implied, 
  62. with respect to the Product, including its quality, performance, 
  63. merchantability, or fitness for a particular purpose or that the use of 
  64. the software and documentation will not infringe upon any third-party patent, 
  65. copyright, trademark, or other rights.
  66.  
  67. In no event will Microtest be liable for direct, indirect, special,
  68. incidental, or consequential damages arising out of the use of or inability
  69. to use the Product, even if advised of the possibility of such damages. In
  70. no case shall Microtest's liability exceed the amount of the license fee.
  71. The warranty and remedies set forth above are exclusive and in lieu of all
  72. others, oral or written, express or implied. No Microtest dealer,
  73. distributor, agent, or employee is authorized to make any modification or
  74. addition to this warranty.

  76. U.S. Government Restricted Rights
  77.  
  78. If the Product is licensed by or on behalf of a unit or agency of the
  79. United States government, this paragraph, in addition to the other
  80. provisions of this License Agreement applies. The Software is Restricted
  81. Computer Software as defined in FAR 52.227-14(a) and 52.227-19(a). Use,
  82. duplication, and disclosure by the government is subject to restrictions
  83. set forth in FAR 52.227-19(c).

  85. General

  87. This License Agreement constitutes the entire agreement between you and
  88. Microtest with respect to the Product and supersedes all prior or
  89. contemporaneous agreements, written or oral, between the parties as to the
  90. subject matter hereof. No modifications or amendment to this License
  91. Agreement shall be binding unless in writing and signed by you and
  92. Microtest. In the event you issue a purchase order or other instrument
  93. concerning the Product, it is understood that such purchase order or other
  94. instrument is for your internal purposes only and any and all terms
  95. contained therein, whether printed or written, shall be of no force or
  96. effect.
